Child Support Modification

Child support modification is a process in which the court reviews the case because there have been material changes in the situation which may affect the non-custodial parent's ability to make child support payments. There are many different changes which may be considered grounds for child support modification - including but not limited to: a change in the amount the non-custodial parent is paid, the 'coming of age' of a child the non-custodial parent is supporting, a situation where the non-custodial parent is suddenly paying more for healthcare or other expenses, etc. The attorney of the non-custodial parent must file a request for child support modification and then the judge will look at the current situation and what has changed. He or she will then determine whether the amount of the child support payments should be increased or decreased and how much either way. This is a process which can help families stay on top of child support payments, even when significant changes have occured in their lives.
