Paternity Child Support

Custody, Paternity, Child Support and Visitation are all subjects that will be handled in a court of law if a couple divorces or separates. If either parent is unsure of paternity, the court will require a DNA test to ensure who the father of the child is. Then, custody will be determined based on which parent is most able to care for the child or children. After that visitation rights will be discussed and the non-custodial parent will be told whether or not he or she will receive visitation, how much and when it is to take place. The non-custodial parent may be required to pay child support. The judge will look at several factors, including the non-custodial parent's ability to pay, how much money he or she makes, how many children are involved and whether the children require special care such as medical. The judge will then calculate the child support payment amount and issue a court order requiring the non-custodial parent to pay. Any indivdiual who must go to court to address these issues should consider hiring an attorney to represent them and provide them with important information - such as their rights and options under the law.

Fast Facts

  • Fathers who have been tested for paternity and have been proven to NOT be the father of a child are not typically required to pay child support, unless the child is legally adopted by the father.
